High Commissioner defended seafarers’ labor rights

For more than a year, the complaint of the Yusra motor ship crew members about non-payment of wages was under the supervision of the High Commissioner for Human Rights in the Russian Federation.

Information about the conflict was received in April 2016 from deputy of the State Duma of the Federal Assembly of the Russian Federation Oleg Shein.

The owner of the vessel was a Turkish company, but sea cargo transportations were carried out under the Russian jurisdiction (the operating organization was LLC «SaleTrade»). At the time the appeal was filed, wages have not been paid to the crew for several months.

Having familiarized with the materials provided, the High Commissioner sent her representative to Astrakhan to study the situation on the ground.

Considering that the rights of workers to fair wages have been violated, the High Commissioner sent a request to the Prosecutor General of the Russian Federation.

As a result of the audit, the arguments of the seafarers were confirmed. The regional prosecutor’s office sent lawsuits to the court, which resulted in decisions on collection of wage arrears totaling more than 239 thousand rubles.

In addition, the operating organization and its head were brought to administrative responsibility in the form of fines for violation of labor laws and failure to provide primary statistics.

The High Commissioner continues to keep the situation under personal control and subsequently information was received by employees of the High Commissioner’s Office that enforcement of court decisions was carried out, as a result of which the crew of the ship was paid in full.

Thus, labor rights of citizens were restored.
